There is a tremendous debate on the private ownership of guns in America. When we first look at this debate, we have to look at the originating document that caused this debate – The United States Constitution, our 2nd law if we consider that the first independent law in this country was the Mayflower Compact. So what does our Constitution say? In our 2nd Amendment under the Bill of Rights, which are the individual Rights of each citizen that will be upheld by the federal government, it says:

“A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed.”

This is an obvious disjointed or separated sentence, meaning that with the inclusion of a “comma” there becomes two separate issues.

Issue one is a guarantee under federal law (The Constitution) that each State will be unrestricted by the federal government in creating, funding, and activating their own State Guard, fully armed and militarily equipped without the federal government’s permission. This seems to be exactly what is in effect with the Army National Guard and the Air Force National Guard.

Now the second issue, and certainly one of the most contested issue of our times:

“…, the right of the People to keep and bear arms shall not be infringed.”

Do we really need to be more educated than the individuals who wrote this entry? How much debate is needed to say that we own this right as citizens of this country? Is this our Right or does it belong to the government?

And what I can find amusing, if anything really is about this issue, is that the simplest 14 words can involve such continual Executive, Legislative, and Judicial debate. You just have to wonder why right?
